DRAFT RESOLUTION

THE SECURITY COUNCIL,

Recalling Chapter VII, Article 41 of the United Nations Charter empowering this body to impose sanctions,

Affirming the applicability of the Universal Declaration of Human Rights, the Fourth Geneva Convention, the studies and findings of the Office for the Coordination of Humanitarian Affairs, and all other relevant documents, conventions, papers, and resolutions to civilians living within sanctioned states,

Deeply conscious of the potential detriment sanctions pose to civilians,

Recognizing the inherent sovereignty of all States,

Stressing the need to exhaust any and all proactive measures before this body imposes sanctions, as called for in the letter from the permanent five members to the President of the Security Council in S/1995/300,

Affirming the use of smart sanctions, as defined by the Secretary General’s remarks in SG/SM/7360, as the means of concretizing the decisions of this body,

  1. Calls upon the Security Council Working Group on Sanctions to meet regularly with individual Sanctions Committees, humanitarian Non-Governmental Organizations and Inter-Governmental Organizations to evaluate the effectiveness of and active compliance with the imposed sanctions as well as the humanitarian issues created by sanctions and to provide those findings to this body in the form of semi-annual reports;

  2. Resolves to lessen through a gradually declining process, imposed sanctions based on the evaluation reports of the Working Group in regard to active compliance by the sanctioned entity and the unintended effects that have developed as an outgrowth of the sanctions;

  3. Calls for pending review by the Working Group, in response to positive developments made by sanctioned entities on a case by case basis;

  4. Proclaims that sanctioned member States will be allowed to present their cases directly to the Security Council to ensure a direct means of communication;

  5. Decides to remain seized upon the matter.

THE SECURITY COUNCIL,

Noting with regret the ineffectiveness of established sanctions’ ability to stem the actions of a country which has proven resilient to diplomatic actions,

Affirming the necessity of sanctions imposed on countries who consistently disregard the wishes of the United Nations,

Keeping in mind the need for a multilateral body of like mind to effectively persuade the violating country to abide by resolutions supported by the Security Council,

Noting with deep concern the actions of states which circumvent the policies of the United Nations thereby breaking the sanctions imposed,

Stressing the need for effective countermeasures for nations who disregard diplomatic resolutions and sanctions,

Believing that effective sanctions which quickly bring sanctioned states and non-state actors into compliance decreases the pain and suffering of a state’s populace,

Affirming the Universal Declaration of Human Rights and the need for effective application of the will of the United Nations,

Emphasizing the deliberate disregard for the sanctions imposed by the United Nations by sanction violating states and non-state actors,

Acting under Chapter 7 of the United Nations Charter,

  1. Supports the enforcement of sanctions through freezing of assets, both financial and physical, of sanction breaking state and non-state actors;

  2. Strongly urges that states freeze funds for state or non-state actors found to be violating sanctions for a period to be determined by the Security Council;

  3. Recognizes that the state or non-state actors guilty of breaking sanctions are those giving direct and illegal support to the sanctioned entities;

  4. Calls upon Member States to facilitate the enforcement of the penalties described herein;

  5. Affirms that any penalties involving the violation of sanctions imposed by the Security Council against state or non-state actors be decided on a case by case basis by the Security Council;

  6. Emphasizes that the ultimate goal of the penalties described herein be the fulfillment of sanctioned state and non-state actors’ obligations;

  7. Requests that the General Assembly review this resolution at its next session;

  8. Decides to remain seized of this matter.

DRAFT RESOLUTION

THE SECURITY COUNCIL,

Recognizing the inability of post-conflict nations to regain a functioning economy without outside assistance,

Noting the economic and cultural problems associated with immigration of foreign refugees,

Emphasizing the instability caused to a nation when its citizens are unable or unwilling to return to their country due to the effects of war,

Stressing the immediate needs of former military personnel to be provided with food, medical assistance and stable shelter,

Affirming the stabilizing nature of the family unit,

Acknowledging the crucial role of non-governmental organizations and intergovernmental organizations in providing humanitarian assistance to conflict afflicted regions,

Realizing the long term need of marginalized citizens such as demobilized soldiers and refugees to be reintegrated into society with sustainable employment,

  1. Strongly encourages member states to contribute financial assistance to infrastructure restoration projects in post-conflict states;

  2. Calls for Working Groups to monitor the progress of infrastructure building in post-conflict states where Member States have contributed financial assistance;

  3. Affirms that the suggestions described herein do not form a predetermined model, but merely suggest as options some proven solutions to widespread problems of post-conflict states;

  4. Encourages post-conflict states to create, where needed, zones on borders of post-conflict states to provide food, shelter, and medical assistance to returning refugees;

  5. Encourages post-conflict states to create, where needed, quartering areas for demobilized soldiers to receive immediate shelter and physical assistance;

  6. Encourages post-conflict states to create, where needed, training facilities to equip demilitarized soldiers and returning refugees with the vocational skills needed for economic, familial and social reintegration;

  7. Encourages post-conflict states to formally appeal to the United Nations for assistance from NGOs, IGOs, and member states in the funding of restoration initiatives, such as infrastructure rebuilding projects, the establishment of refugee resettlement zones, the creation of quartering areas, and the setup of vocational training facilities;

  8. Recommends NGOs, IGOs, and member states comply with the requests of post-conflict states for the establishment of restoration initiatives, such as training facilities, quartering areas, refugee resettlement zones, and infrastructure rebuilding projects in order to make feasible the goals of lasting peace and sustainability;

  9. Decides to remain seized on the matter.

DRAFT RESOLUTION

THE SECURITY COUNCIL,

Reaffirming the inherent sovereignty of all nations,

Recognizing the significance of the removal of all current and past United Nations sanctions on countries being rebuilt,

Recognizing the multi-lateral nature of nation-building,

Recalling Chapter 7, Article 43 of the United Nations Charter empowering the Security Council to establish an objective to maintain peacekeeping and security interests of the United Nations,

Acknowledging the necessity of a ceasefire to be in place before United Nations assistance will be initiated,

Recalling work done by the General Assembly social, humanitarian, and cultural committee, also known as the third committee, in regards to refugee issues,

  1. Emphasizes the need for a standing sovereign government and for domestic security to be in place throughout United Nations assistance;

  2. Stipulates that countries, nations, or territories in question petition to the Security Council, during a time of peace, for the establishment of the sub-committee to consider the merits of nation-building;

  3. Designates the creation of a Security Council sub-committee to study and submit recommendations to be made of the following members:

    1. Territory/Nation being rebuilt,

    2. Two of the following: France, United Kingdom, China, Russian Federation, and United States, to be elected by majority vote of the Security Council, and

    3. Two rotating permanent General Assembly states actively participating in the peacekeeping effort;

  4. Directs the sub-committee to focus upon:

    1. stable infrastructure of agriculture, construction, and currency rate,

    2. potential standing government, and 

    3. humanitarian needs to minimize the negative affects on citizens in the nation being built;

  5. Demands compliance with the Universal Declaration of Human Rights Articles 3 and 5;

  6. Decides to remain seized on this matter.
